Why Appointing the Wrong Safety Officer Could Cost You

In the high-risk world of construction, every decision carries weight, none more so than the appointment of your site’s Safety Officer. A common misconception in the industry is that any individual with basic safety knowledge or experience can fill the role. But according to Construction Regulation 8(5) of the Occupational Health and Safety Act (OHS Act) and the SACPCMP (South African Council for the Project and Construction Management Professions), that simply isn’t true.

In reality, appointing someone without the correct registration or qualifications can lead to site shutdowns and legal liability. This blog explores why the law requires a registered CHSO (Construction Health and Safety Officer), what makes a safety officer legally compliant, and how Zenith Safety Consultants (ZSC) helps ensure your project stays on the right side of the law.

SACPCMP Registration

What the Law Actually Says

Construction Regulation 8(5) is clear:

“A contractor must, after consultation with the client and having considered the size of the project, the degree of danger likely to be encountered or the accumulation of hazards or risks on the site, appoint a full-time or part-time construction health and safety officer in writing to assist in the control of all health and safety related aspects on the site: Provided that, where the question arises as to whether a construction health and safety officer is necessary, the decision of an inspector is decisive”

This requirement is reinforced by SACPCMP rules, which govern who may legally act as a CHSO. An individual must hold valid registration with SACPCMP to be recognised as a competent appointee. Failure to comply not only breaches regulations.

The Risks of Appointing the Wrong Person

Too often, companies take shortcuts by assigning an unregistered or inexperienced individual to a role that demands legal, technical, and procedural competence. Here’s what’s truly at stake:

  • Non-compliance with CR 8(5) and SACPCMP regulations – An unregistered individual acting as a CHSO renders the site non-compliant by default.
  • Site shutdowns and penalties – The Department conducts unannounced inspections. If your appointed safety officer is not SACPCMP-registered, an instruction to appoint a compliant officer is typically issued. Failure to comply with this directive may lead to site stoppages, legal notices, or enforcement action.
  • Rejected insurance claims – If a serious incident occurs, your insurer may refuse claims if the person responsible for your safety file isn’t properly appointed.
  • Civil and criminal liability – Directors, project managers, and site agents may face personal liability for injuries or deaths under the OHS Act.
  • No legal defensibility – Without a registered CHSO with the required training and qualifications, signing off on your documentation, like risk assessments, fall protection plans, and method statements, you have no valid proof of due diligence.

The appointment of the wrong person doesn't just threaten compliance. It places your team, your finances, and your project reputation in danger.

What Makes a Legally Appointed CHSO “Compliant”?

A compliant CHSO isn’t just “experienced.” They must meet specific legal criteria, including:

  • ✔️ Valid SACPCMP Registration – Only those registered as a CHSO, PrCHSA (Professional Construction Health and Safety Agent), or PrCHSM (Manager) are recognised.
  • ✔️ A formal letter of appointment from the contractor – This letter must be signed and dated, clearly stating the duties, authority, and scope of responsibility assigned to the Construction Health and Safety Officer (CHSO). It should reference relevant legislation (e.g. Construction Regulation 8) and must be kept on file.
  • ✔️ Documented proof of competencies – The appointed CHSO must have formal proof of qualifications, SACPCMP registration, and any relevant training certificates included in the safety file. These documents must demonstrate that the registered safety professional is capable of developing, implementing, and managing a full Health and Safety Management System, in line with the project's scope and applicable legislation.
  • ✔️ Comprehensive legislative knowledge – Including the OHS Act, Construction Regulations, General Safety Regulations, and task-specific rules.
  • ✔️ Technical skills in safety file management – From inductions and inspections to risk assessments, registers, toolbox talks, and incident investigations, the CHSO must manage the entire system.

In short: without proper registration, appointment, and capability, you are not compliant, no matter how long the individual has been “doing safety.”
